First consultation is free
First Tara Mediation will have a free consultation with you. Following the first consultation there will be an interview mapping your personal and financial situation. Tara Mediation will provide legal information and will help you to come to a settlement agreement for your future.
The following issues are mostly addressed:
Arrangement concerning parental access
Child support
Partner alimony
Division of property (i.e. division of pension, debts, savings, furniture)
The agreements will be recorded in a settlement agreement together with you. The legal phrasing will be done by Tara Mediation. Tara Mediation will explain the meaning of the agreement in practice.
Once the agreement has been finalized and the content of the settlement agreement and/or parenting plan has been approved by both parties, both parties can sign the agreements.
Tara Mediation will subsequently take care of filing the mutual request for divorce in court by a lawyer. Further completion of the divorce until the registration of the court’s decision with respect to the divorce into the registry of marriage will be monitored by Tara Mediation.
You do not need to appear before the lawyer or in court as both of you already have agreed upon the content of the settlement agreement and/or parenting plan and it concerns mutual request for divorce.
Mutual request for divorce or termination of partnership for €909,00 (including VAT , legal fee (griffierecht) and attorney’s fee)
Should mediation not be required and both of you already have come to agreements recorded in a settlement agreement (and if necessary a parenting plan), Tara Mediation offers you the possibility to have the mutual request for divorce or termination of partnership filed in the Court of Amsterdam for €909,00 (including VAT , legal fee (griffierecht) and attorney’s fee).
Tara Mediation will study the content of the settlement agreement (and if necessary a parenting plan). If necessary, Tara Mediation will also advice with respect to the content of these documents. The final settlement agreement (and if necessary a parenting plan)in threefold initialed on each page and signed by the both of you together with the necessary extracts will be attached to the mutual request for divorce or termination of partnership. This mutual request for divorce or termination of partnership will be filed by an attorney in the Court of Amsterdam.
Provided that all documents attached to the mutual request for divorce or termination of partnership are correct and complete, the court will decide within 6 weeks as of the date of filing. Once both of you have agreed with the content of the decision and both of you have signed the waiver of appeal (akte van berusting), registration of the court’s decision with respect to the divorce or termination of partnership can be done in the registry of marriage/ the registry of partnership.
